I acknowledge and agree that as a member of the gym, in consideration of the Gym allowing me to use its facilities, attend classes and work with personal trainers (whether a group class or a private session) I agree with the Gym as follows:-

1. I acknowledge that the Gym has rules and I agree to be bound by any rules and regulations that the Gym and its staff issue regarding the conduct of the classes, personal training or or any other activity organised by the Gym.

2. To release the Gym and all sub-contractors working within the facility from all liability for any claim, demand or damage or personal injury or illness sustained by me; (a) arising from or in respect of my participation in any class or other activity (weight lifting or otherwise) arranged by or on behalf of the Gym, whether or not the injury is caused by the Gym or any other person using the gym or activity wherever the class or activity is held; (b) whether or not the damage, personal injury or illness arises from the negligence or breach of any statutory duty of the Gym or any other member of the class or activity.

3. I confirm that I do not have any injury or illness could be aggravated by my participation in the classes or other activities other than disclosed by me above and I acknowledge that the Gym is relying on this statement in allowing me to participate in the use of the gym facility. If I suffer any such illness or injury I agree to notify the Instructor immediately.

4. I acknowledge that:- (a) in the conduct of the classes and/or personal training or other activity some physical contact may occur between myself and the Gym staff or myself and other members of the gym; and (b) I consent to that contact being made; and (c) I will not hold the Gym, its staff or any other member of the gym responsible for any injury or illness I may suffer in respect of that contact.

5. I understand and accept that some of the activities may be run outside of Shop 7/445 Grimshaw Street Bundoora. I accept that training outside of the facility provides a greater risk for me with more tripping hazards, harder concrete surfaces and motor vehicles present. I understand and accept the risk and understand that by signing this document all training outside of the facility is at my own risk and the gym is not liable for any claims made against it.

6. I acknowledge that Gym on Grimshaw Pty Ltd is not liable for any claim or demand for damage or personal injury or illness sustained by me as a result of any social function in which I may choose to participate, even if the event is arranged, organised or directed by Gym on Grimshaw Pty Ltd, its Directors or members or clients or any third party.

7. I certify that all information provided by me to the Instructor in the application form attached, or in any other way is true and correct.

24/7 disclaimer- INDEMNITY T0: Gym on Grimshaw PTY. LTD (‘The Gym’)

I acknowledge and agree that as a member or casual member of the gym, in consideration with the gym allowing me to use it’s facilities, attend classes and work with personal trainers I agree with the gym as follows-

1. Gym on Grimshaw has a zero tolerance on anti-social behavior. Any person exhibiting behavior that is deemed offensive to other patron(s) will not be accepted within our gym.

2. Please promptly put all weights away disinfected after use and use equipment with care and respect.

3. Please turn off all fans, toilet lights and shut the back door after use.

4. In the case of power or lighting interruption during unstaffed hours please leave the premises and report the fault immediately to management on 94669666.

5. Please wear appropriate clothing and closed toe shoes at all times.

6. During 24/7 periods do not let any non 24/7 members into Gym on Grimshaw Pty Ltd.

7. At no times should you give your access device to anyone else to use. Do not let anyone else in with your access device.

8. Do no use collars on olympic bars that prevent the weights from moving off the bar for any forms of bench press (Standard, Decline and Incline) The exercises can be fatal for anyone who is stuck under the bar without a spotter. You must use a spotter using the olympic bar for bench press at all times during 24/7 periods.

9. In the case of a medical emergency during 24/7 times it is the responsibility of the patron (s) within the facility to make the decision to press the panic duress button to seek further help.

10. The panic duress button will contact the control room which will promptly contact management to attend and send a patrol car down. Control room will then promptly view live CCTV footage and make a decision on who to call next. In an emergency situation as a patron please do not hesitate to call 000 after pushing the wireless panic duress button.

11. When training alone during times of 24/7 access you must wear the wireless panic duress button to contact the control room should you encounter an emergency situation.

12. Please report all first aid concerns or incidents during periods of 24/7 promptly to management on 94669666 or to staff during staffed hours.

13. Emergency exits are marked and located at the front and back of the gym.

14. Please report any machinery faults immediately during staffed hours to reception or by calling management on 94669666 during 24/7 periods. Do not use any machinery if it appears faulty.

15. All gym footage is under surveillance. If any footage of incidents is requested to be viewed you must notify Gym on Grimshaw within 48 hours.

16. Always test to see if equipment is properly secured (rings, trx, attachments) before use and never use any equipment that appears to be faulty or unsecure and report immediately to 94669666.

17. I acknowledge that the shower presents a wet area that can be at times unsafe underfoot. I assume responsibility for my actions and acknowledge that there is a panic button in the shower that I must press if a threatening situation arises.

18. I acknowledge and accept that there is a panic button on the sauna door and next to the ice plunge labelled that must be pressed in any emergency situation regarding your health and safety.

In order to stop the spread of disease I acknowledge that on top of daily disinfecting by staff it is essential to also spray and wipe down surfaces before and after your infrared sauna and ice plunge session with the bottle and paper towel available. It is essential to bring a towel that covers your whole body so no sweat is caught dripping on the wood or heaters.

If you suffer from any of the following conditions or if any of these conditions apply to you then you will require medical clearance from your GP prior to booking and using the infrared sauna and ice plunge; low blood pressure, prescription medication, cardiovascular conditions, pregnancy, artificial implants/devices, Parkinson’s, Multiple Sclerosis.

19. I understand that I must verbally inform any staff member (s) of any food allergies or intolerances before I consume any food or beverage at Gym on Grimshaw 24/7 and read all ingredient labels thoroughly before consumption. I take full responsibility of all risk involved.

20. Gym on Grimshaw 24/7 as a part of Debits direct is reuired to use an industry standard $10 failure fee on any direct debit payments that are unsuccessful. All direct debit membeships require one month notice of cancellaton.

21. I confirm that I understand and am confident with how to use the equipment and if uncertain I will visit during staffed times or call reception on 94664666 to have any questions answered.

22. I can confirm that I do not require medical clearance from a doctor before I perform any exercise at Gym on Grimshaw Pty Ltd. If anything changes in the future I can confirm that I will promptly let management know before participating in any exercise at Gym on Grimshaw Pty Ltd.

23. I can confirm that by purchasing a casual pass from the online shop, signing a membership applicaton and gaining access to Gym on Grimshaw Pty Ltd I have become a member to Gym On of Grimshaw Pty Ltd and have been presented with all the information required about where the panic buttons are situated and how to act in an emergency situation.

24. For the safety of all patrons and systems cameras are viewed with each payment notification we receive to validate identity and check overall safety of premises.

I understand and acknowledge that the staffed hours are located and displayed on the front door and understand that the gym is unmanned by staff members at all other times. 24/7 unmanned hours are currently

I understand and agree that these hours are unmanned and may be subject to change due to Christmas holidays, public holidays and availability of staff.
